Eminent Domain & Condemnation Law

Pennsylvania Eminent Domain Attorney

Former PennDot Trial Attorney Provides Aggressive Representation

When your property is threatened by condemnation proceedings it means that a government agency is permitted to take your private property for a public improvement. If you own property subject to government condemnation proceedings, whether in the Freedom-Crider Road Upgrade area in Beaver County, or throughout Pennsylvania, you want to hire an experienced eminent domain attorney.

Free Initial Consultations • Contingent Fees • Hourly Fees Available

At the Law Offices of Kathryn Linn-Stevenson, in Evans City and Butler, Pennsylvania, I represent individuals and businesses throughout Pennsylvania in cases involving government attempts to condemn and take property for public purposes. This threat is a frightening experience for many. If your property is targeted by eminent domain proceedings, you will want to consult an attorney experienced in eminent domain law immediately. Valuable rights may be lost if you wait too long.

The Pennsylvania Eminent Domain Code provides that you must be paid Just Compensation for the property taken. Many rights may be affected concerning a number of different property interests such as:

  • residential property
  • business property
  • investment property
  • full or partial takings
  • business dislocation damages
  • moving expenses
  • rental or mortgage assistance payments

I have practiced condemnation for over twenty years; over half of that time was spent as trial counsel for the Pennsylvania Department of Transportation (a condemnor's attorney). Now, as a property owners' attorney (a condemnee's attorney) I am available to help you obtain all of the monies and assistance which the law allows.

I have traveled all over Western Pennsylvania litigating eminent domain cases in many counties such as: Allegheny, Armstrong, Beaver, Blair, Butler, Cameron and Erie. Currently, I am involved in eminent domain cases in the Freedom-Crider road Upgrade project in Beaver County, the proposed takings for the Butler County Sewer Authority, as well as, the redevelopment project gearing up in Butler County.

In my eminent domain practice, I work with homeowners and businesses, ensuring that all factors are considered when property is valued and when just compensation is determined. In addition to the fair market value of your property, I will aggressively fight to help you obtain dislocation or relocation damages, including compensation to cover the cost of moving.

Whether you have actually been contacted by the government or simply have reason to believe that your property may become part of an eminent domain proceeding, here are some guidelines to follow to protect your interests:

Eminent Domain Dos and Don'ts

  • Don't accept the first offer without consulting an attorney. An attorney can assist you in receiving the government's offer and continuing on with the litigation process. The amount of the first offer is yours to keep.
  • Don't offer your opinion to the governmental agency concerning what amount you feel your property is worth.
  • Don't give your own appraisal to the governmental agency.
  • Don't try to negotiate any offers from the government.
  • Do obtain an experienced lawyer who will not take any of your initial offer; the contingent fee is based on what I am able to obtain for you over and above the initial offer.

Contact me, I will help you through the process.

I provide a free initial consultation to all eminent domain/condemnation clients. My office is open from 9 am until 5 pm, Monday through Friday. I can travel to meet you at a location that is convenient for you.
